Agreement to These Terms
These Terms of Service ("Terms") apply to your access to and use of the Sterling Claims website, the Sterling Claims Portal at portal.sterling-claims.com, and related online tools, communications, and services that link to these Terms.
By accessing the Portal, submitting a request, uploading information, or using our online services, you agree to these Terms. If you do not agree, do not use the Portal or related online services.
Separate written agreements, service orders, statements of work, carrier guidelines, inspector agreements, or customer contracts may apply to specific services. If a separate written agreement conflicts with these Terms, the separate agreement controls for the covered services.
Portal Accounts
The Portal is intended for authorized business users, including adjusters, carriers, property claim professionals, vendors, inspectors, and other representatives approved by Sterling Claims or its customers.
- You must provide accurate account and contact information and keep it current.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must promptly notify Sterling Claims if you suspect unauthorized access or misuse of your account.
- You may not share credentials, access another user's account, or use the Portal for anyone you are not authorized to represent.
Information and Materials You Submit
You are responsible for the accuracy, completeness, legality, and authorization of information you submit through the Portal or provide to Sterling Claims, including claim details, property information, photos, documents, measurements, notes, and contact information.
You represent that you have the rights and permissions needed to submit the information and materials you provide. You grant Sterling Claims a limited right to use, process, store, copy, transmit, and share those materials as needed to provide services, operate the Portal, support customers, comply with legal obligations, and enforce agreements.
Do not upload unnecessary sensitive information, including Social Security numbers, payment card numbers, health information, or unrelated personal documents, unless Sterling Claims specifically requests it for a legitimate business reason.
Services and Reports
Sterling Claims provides claim-related inspection, ladder assist, documentation, estimating, tarping, imaging, and related services. Service availability, timelines, deliverables, fees, and performance standards may depend on the applicable customer agreement, order details, location, weather, property access, safety conditions, and inspector availability.
Reports, photos, estimates, measurements, notes, and other deliverables are prepared for the requested claim-related purpose based on the information available at the time. Sterling Claims does not decide insurance coverage, policy interpretation, claim payment, or legal rights. Unless separately agreed in writing, Sterling Claims is not providing legal, engineering, architectural, public adjusting, or insurance coverage advice.
You are responsible for reviewing deliverables and notifying Sterling Claims promptly about any suspected error, omission, access issue, or correction request.
Fees and Payment
Fees, billing terms, taxes, expenses, cancellation charges, rush charges, and payment timing are governed by the applicable service order, invoice, portal workflow, customer agreement, or written quote. You agree to pay all amounts owed for services requested by you or your authorized users.
Unless required by law or expressly stated in writing, fees are non-refundable once services have been performed or costs have been incurred.
Acceptable Use
You agree not to:
- Use the Portal for unlawful, fraudulent, abusive, or unauthorized purposes.
- Submit false, misleading, infringing, confidential, or unauthorized information.
- Interfere with Portal security, availability, performance, or integrity.
- Reverse engineer, scrape, copy, crawl, or harvest Portal content except as allowed by law or written agreement.
- Upload malware, harmful code, spam, or content that violates another person's rights.
- Attempt to bypass access controls, rate limits, authentication, or security features.
Confidentiality and Security
The Portal may contain claim files, reports, business information, pricing, service details, personal information, and other non-public materials. You agree to access and use this information only for authorized business purposes and to protect it from unauthorized use or disclosure.
You are responsible for the security of your devices, networks, accounts, and users. Sterling Claims may suspend or restrict access if we believe an account, request, upload, or activity creates a security, legal, operational, or reputational risk.
Intellectual Property
Sterling Claims and its licensors own the Portal, website, software, designs, workflows, trademarks, logos, templates, and other materials we provide, except for information or materials submitted by users or third parties. These Terms do not transfer ownership of Sterling Claims intellectual property to you.
Subject to these Terms and any applicable written agreement, Sterling Claims grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Portal for authorized business purposes.
Third-Party Services
The Portal and related services may integrate with or link to third-party services, including hosting, communications, mapping, file storage, analytics, payment, or customer systems. Third-party services are governed by their own terms and privacy practices. Sterling Claims is not responsible for third-party services that it does not control.
Disclaimers
The Portal and online services are provided on an "as is" and "as available" basis, except as expressly stated in a separate written agreement. Sterling Claims does not guarantee that the Portal will be uninterrupted, error-free, or available at all times, or that every defect will be corrected immediately.
To the fullest extent permitted by law, Sterling Claims disclaims warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of dealing.
Limitation of Liability
To the fullest extent permitted by law, Sterling Claims will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising from or related to the Portal or these Terms.
Unless a separate written agreement states otherwise, Sterling Claims' total liability for claims arising from or related to the Portal or these Terms will not exceed the amounts paid to Sterling Claims for the specific service or Portal activity giving rise to the claim during the three months before the event at issue.
Suspension and Termination
Sterling Claims may suspend, restrict, or terminate access to the Portal if we believe you violated these Terms, created a security or legal risk, failed to pay amounts owed, or no longer have authorization to use the Portal. You may stop using the Portal at any time, but obligations that by their nature should survive will survive, including payment, confidentiality, ownership, disclaimers, liability limits, and dispute-related terms.

These Terms are governed by applicable U.S. law and any governing-law provision in a separate written agreement that applies to the relevant account, customer, assignment, or service. If there is no separate written agreement, the parties will first try to resolve disputes informally in good faith.
